Terms of Service

1. Eligibility

You must be at least 13years old to use Kached. Some catalogue content is intended for adults; it is hidden by default and you may only enable it if you are 18 or older. If you use Kached on behalf of an organization, you represent that you're authorized to accept these Terms for it.

2. Your account

You're responsible for the activity on your account and for keeping your sign-in method secure. Provide accurate information, and let us know promptly if you suspect unauthorized use. You may delete your account at any time from the app's settings.

3. Your content

You keep ownership of the content you create on Kached — your posts, reviews, ratings, lists, journal entries, comments and uploads. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display and distribute that content solely to operate and improve Kached and to show it to the audience you choose. This license ends when you delete the content or your account, except for content others have already re-shared, content reasonably retained for safety or legal reasons, and residual backup copies.

You represent that you have the rights to the content you post and that it doesn't violate these Terms or anyone's rights. You're responsible for your content.

Catalogue contributions

Kached's catalogue is collaborative. When you propose, add or edit catalogue content — such as new items, collections, page blocks, tags, descriptions or artwork — you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish and display that contribution as part of the catalogue and to let other users access and build on it. Because the catalogue is a shared resource, contributions are reviewed and may be edited, merged, rejected or removed, and accepted contributions may remain in the catalogue (in de-identified form) even after you delete your account. You represent that you have the right to contribute the content and that it doesn't infringe anyone's rights.

4. Acceptable use

You agree not to:

• Post content that is illegal, infringing, harassing, hateful, threatening, or sexually exploitative of minors.
• Impersonate others, or misrepresent your affiliation with a person or entity.
• Spam, scrape, circumvent rate limits, or use bots to access the service except as expressly permitted.
• Attempt to break, overload, reverse-engineer or gain unauthorized access to Kached or its systems.
• Infringe intellectual property rights or misuse third-party content.
• Violate any applicable law.

5. Moderation

To keep the community healthy, we may remove content, limit visibility, or suspend or terminate accounts that violate these Terms. Kached provides reporting and blocking tools, and we may act on reports at our discretion. We may report apparent child sexual abuse material or exploitation to the appropriate authorities. We aren't obligated to monitor all content, and we aren't responsible for content posted by users.

7. Kached's intellectual property

The Kached name, logo, app, website and original design and software are owned by us and protected by intellectual property laws. These Terms don't grant you any right to use our branding without our prior written permission.

8. Purchases, subscriptions & app stores

Kached may offer paid subscriptions or premium features. Pricing, billing, renewal, cancellation and refunds are handled through the applicable app store or payment provider unless otherwise stated. Your use of Kached may also be subject to the Apple App Store or Google Play terms.

9. Disclaimers

Kached is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the service will be uninterrupted, error-free or secure, or that catalogue data will be accurate or complete. Some features may be experimental, incomplete, or change over time.

10. Limitation of liability

To the maximum extent permitted by law, Jonathan Romero will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, goodwill or profits, arising from your use of Kached. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim (if any) or USD $100.

11. Indemnification

You agree to indemnify and hold harmless Jonathan Romero from claims, damages and expenses (including reasonable legal fees) arising out of your content, your use of Kached, or your violation of these Terms or applicable law.

12. Termination

You may stop using Kached and delete your account at any time. We may suspend or terminate your access if you violate these Terms or where we reasonably believe it's necessary to protect the service or other users. Sections that by their nature should survive termination — such as content licenses for already-shared content, disclaimers, liability limits and indemnities — will continue to apply.

13. Governing law

These Terms are governed by the laws of the State of Kentucky and the United States, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in Kentucky, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes we'll update the date above and, where appropriate, notify you in the app. Continuing to use Kached after an update means you accept the revised Terms.
